Privacy Policy

This Privacy Policy explains how Redwyss collects and processes personal data. It is not an exhaustive description; other privacy policies may govern specific matters. Personal data means any information relating to an identified or identifiable individual.

If you provide Redwyss with personal data of other individuals (e.g. family members, colleagues), please ensure that these individuals are aware of this Privacy Policy and only share such personal data with Redwyss if you are authorised to do so and if the data is accurate.

This Privacy Policy is designed to meet the requirements of the EU General Data Protection Regulation («GDPR»), the Swiss Federal Act on Data Protection («FADP») and the revised Swiss Federal Act on Data Protection («revFADP»). Whether and to what extent these laws apply depends on the individual case.

2. Collection and Processing of Personal Data

Redwyss primarily processes personal data received from customers and other business partners – and related individuals – as part of business relationships, or personal data collected from users when operating the website and other applications.

Where permitted, Redwyss also obtains certain data from publicly accessible sources (e.g. debt collection registers, land registers, commercial registers, press, internet etc.) or receives such data from customers, authorities and other third parties. In addition to the data you provide directly, the categories of personal data Redwyss receives from third parties about you include, in particular: information from public registers, information in connection with legal proceedings, details relating to your professional functions and activities, information from correspondence and discussions with third parties, credit information, information from persons in your environment, data from banks, insurers, distribution and other partners, information from media and the internet, addresses, interests and other sociodemographic data (for marketing), and usage data relating to the website (e.g. IP address, MAC address, device details, cookies, time and date of visits, accessed pages, functions used, referring website, location data).

3. Purposes of Data Processing and Legal Basis

Redwyss primarily uses personal data to conclude and perform contracts with customers and business partners, in particular in connection with tax and corporate advisory services, as well as for the procurement of products and services from suppliers and subcontractors, and to comply with legal obligations in Switzerland and abroad.

In addition, Redwyss processes personal data – where permitted and appropriate – also for the following purposes, where Redwyss (and sometimes third parties) have a legitimate interest corresponding to the purpose:

  • Providing and developing Redwyss’ services, website, apps and platforms;
  • Market and opinion research, media monitoring;
  • Establishment of legal claims and defence in legal disputes and proceedings;
  • Prevention and investigation of offences and other misconduct (e.g. internal investigations, fraud prevention);
  • Ensuring operations, in particular IT, website, apps and platforms;
  • Business transactions such as the purchase or sale of business units or companies;
  • Measures for business management and compliance with legal and regulatory obligations.

Where you have given Redwyss consent to process your personal data for specific purposes (e.g. background checks), Redwyss will process your personal data within the scope of and based on this consent. Consent can be withdrawn at any time, although this does not affect data processing already carried out.

4. Cookies

Redwyss uses cookies and similar technologies on its website. These are used, for example, to identify your browser or device, store settings, and analyse user behaviour.

Redwyss also uses social media plug-ins (e.g. LinkedIn). By clicking on the icons, you will be redirected to Redwyss’ social media channels. The processing of your data then lies within the responsibility of the relevant provider under its own privacy policy.

5. Data disclosure and transfer abroad

In connection with the purposes set out in section 3, Redwyss may disclose personal data to third parties, in particular to:

  • Service providers (e.g. IT providers, banks, insurers);
  • Dealers, suppliers, subcontractors, business partners;
  • Customers and their affiliates;
  • Authorities, courts, media, the public;
  • Competitors, associations, industry organisations;
  • Counterparties in transactions or proceedings.

Such recipients may be located in Switzerland or abroad. You should expect your data to be transferred worldwide.

6. Data Retention

Redwyss retains personal data for as long as necessary to fulfil contractual, legal or business purposes. Thereafter, data is generally deleted or anonymised, unless legal retention duties or overriding legitimate interests require otherwise.

7. Data Security

Redwyss stores your data securely and takes appropriate measures to protect it from loss, unauthorised access, misuse or alteration.

8. Obligation to Provide Personal Data

In the context of business relationships, you must provide the personal data necessary to enter into and perform a contract and to comply with related obligations. Without such data, Redwyss will generally not be able to conclude or perform contracts. The use of the website is also not possible without certain disclosures (e.g. IP address for traffic security).

9. Rights of the Data Subject

Within the scope of applicable data protection law (such as the GDPR), you have the right to request access, rectification, erasure, restriction of processing, objection to processing, and data portability. Redwyss reserves the right to apply the legal limitations (e.g. where Redwyss is legally obliged to retain data, has an overriding interest, or requires the data to assert claims).

10. Amendments

Redwyss may amend this Privacy Policy at any time without prior notice. The version published on the website is the applicable one.
